The Holt County Board of Supervisors met as a Board of Equalization with all members present except Keyes. County Assessor Tim Wallinger, County Treasurer Shelly Ross and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on November 9, 2023, in the Atkinson Graphic.

Chairman Frahm convened the meeting at 9:30 A.M. with the flag salute.

Motion by Paxton, 2nd by Breiner, to approve the minutes of the October 31, 2023, meeting as printed. Voting Aye: Treptow, Neiman, Breiner, Paxton, Tielke  and Frahm. Voting Nay: None. Absent: Keyes. Motion carried.

Motion by Paxton, 2nd by Breiner, to approve the tax list correction #23-022 as submitted by the Assessor. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow and Frahm. Voting Nay: None. Absent: Keyes. Motion carried.

The Holt County Board of Supervisors met in regular session as per adjournment with all members present except Keyes. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943.  Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on November 9, 2023, in the Atkinson Graphic.

Chairman Tielke convened the meeting at 9:47 A.M. and informed the public of the location of the Open Meeting Poster.  

Motion by Neiman, 2nd by Paxton, to approve the minutes of the October 31, 2023, meeting as printed. Voting Aye: Treptow, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.

The Board reviewed claims on file.

The Treasurer's Report was presented and placed on file.

Motion by Frahm, 2nd by Paxton, to acknowledge the receipt of the Distress Warrant Report for 2022 on 37 distress warrants for a total of $16,386.59 and has been issued and given to the Holt County Sheriff on November 1, 2023. Voting Aye: Neiman, Breiner, Paxton, Frahm, Paxton, and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.

Motion by Neiman, 2nd by Breiner, to approve the written fee policy for the Holt County Weed Department. This policy is on file in the Clerk's office and Weed Department. Voting Aye: Breiner, Paxton, Frahm, Treptow, Neiman and Tielke. Voting Nay: None.  Absent: Keyes. Motion carried.

Motion by Paxton, 2nd by Breiner, to approve the zoning application for Jason & Candice Schindler for 2 tracts in SE ¼ 1-29-12. Voting Aye: Paxton, Frahm, Treptow, Neiman, Breiner and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.

Motion by  Paxton, 2nd by Neiman, to acknowledge receipt of the 2022 Countywide Cost Allocation Plan as completed by Maximus Consulting Services. Voting Aye: Frahm, Treptow, Neiman, Breiner, Paxton and Tielke. Voting Nay: None.  Absent: Keyes. Motion carried.

Emergency Manager Deb Hilker was present to discuss the Chambers Communication Tower lease with the Board.

Motion by Frahm, 2nd by Treptow, to approve the Communications Tower Lease Agreement with Mark W. Dexter for an annual fee of $1,000.00 for a period of ten (10) years, commencing December 1, 2023, and ending December 1, 2033. The lease agreement shall be for as long as lessee maintains the communications tower on lessor's property. Voting Aye: Treptow, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.

10:15 A.M. being the time advertised, Chairman Tielke opened the Public Hearing to hear public comment and response to a Conservation Easement request for Randall M. and Tara A. North through the Natural Resources Conservation Service. One interested taxpayer was present.

Motion by Frahm, 2nd by Paxton, to adjourn the Public Hearing at 10:20 A.M. to consider the Conservation Easement request for Randall M. and Tara A. North through the Natural Resources Conservation Service. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.

Motion by Frahm, 2nd by Breiner, to deny the Conservation Easement request for Randall M. and Tara A. North through the Natural Resources Conservation Service for the reason that the easement is contrary to Resolution #2021-32, as well as the Holt County Comprehensive Plan. Specifically, the easement will restrict or prohibit numerous agricultural activities. Voting Aye: Breiner, Paxton, Frahm, Treptow, Neiman and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.

Motion by Frahm, 2nd by Breiner, to set for Public Hearing to add solar development regulations to the Holt County Comprehensive Plan and Planning & Zoning Regulations at 10:15 A.M. on December 18, 2023. Voting Aye: Paxton, Frahm, Treptow, Neiman, Breiner and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.

Motion by Neiman, 2nd by Paxton, to convene in Executive Session at 10:25 A.M. for negotiations. Voting Aye: Frahm, Treptow, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.

The Board members, the County Attorney and County Clerk were present in closed session.  

Motion by Paxton, 2nd by Frahm, to adjourn from Executive Session at 11:21 A.M. and reconvene in Open Session. Voting Aye: Treptow, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.   

Chairman Tielke stated that only negotiations were discussed, and no action was taken.

Veterans Service Officer Ken Stenka presented his Quarterly Department Report.

The Finance Committee reported that the County Officials had remitted their monthly fees to the County Treasurer as required.

Motion by Neiman, 2nd by Frahm, to approve the Right of Way permits for Redstone, Inc. for electrical cable for irrigation in 1-31-14 and for Willowbrook Farms for electrical cable for irrigation in Sections 5 & 6-31-13.  Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.

Motion by Frahm, 2nd by Neiman, to consign the surplus 2013 John Deere motorgrader to auction with Pavel Auction Service through Auction Time online auction. Voting Aye: Breiner, Paxton, Frahm, Treptow, Neiman and Tielke. Voting Nay: None. Absent: Keyes. Motion carried.
