The Holt County Board of Supervisors met as a Board of Equalization with all members present. County Assessor Tim Wallinger, County Treasurer Shelly Ross and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on October 19, 2023, in the Atkinson Graphic.

Chairman Frahm convened the meeting at 9:30 A.M. with the flag salute.

Motion by Paxton, 2nd by Tielke, to approve the minutes of the October 16, 2023, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Tielke and Frahm. Voting Nay: None. Motion carried.

Chairman Frahm convened a public hearing at 9:31 A.M. to receive public comment on the Motor Vehicle Tax Exemption Application on file for: Building Blocks for Community Enrichment on a 2013 Chevrolet Impala & 2024 Nissan Altima; Good Samaritan Society – Atkinson on a 2009 Ford Cutaway Van; West Holt Memorial Hospital on a 2001 Ford Ranger. No one appeared to comment.

Motion by Paxton, 2nd by Breiner, to approve the tax list correction #23-021 as submitted by the Assessor. Voting Aye: Keyes, Neiman, Breiner, Paxton, Tielke, Treptow and Frahm. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Neiman, to adjourn the public hearing at 9:38 A.M. and return to regular session. Voting Aye: Neiman, Breiner, Paxton, Tielke, Treptow, Keyes and Frahm.Voting Nay: None. Motion carried.

The Holt County Board of Supervisors met in regular session as per adjournment with all members present. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on October 19, 2023, in the Atkinson Graphic.

Chairman Tielke convened the meeting at 9:45 A.M. and informed the public of the location of the Open Meeting Poster.

Motion by Neiman, 2nd by Keyes, to approve the minutes of the October 16, 2023, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

The Board reviewed claims on file.

Motion by Keyes, 2nd by Treptow, to void checks: #20080090 to Verizon Wireless for $378.91 due to duplicate payment and #21030130 for $200.00 due to existing easement. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Frahm, 2nd by Keyes, to approve the surety bond for Eugene Soukup, Grattan Township Board. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Correspondence was reviewed.

Motion by Paxton, 2nd by Frahm, to adjust the per diem compensation to Planning & Zoning Board members to $15.00 per meeting plus mileage as per state statute 23-114.01. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Neiman, to set the price for brush spraying by the Holt County Weed Department at $200.00 per hour plus chemical plus $1.70 mileage one way. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried. 

9:50 A.M. being the time advertised, time was allowed for public comment. No one appeared to comment.

UNL Extension Educators Amy Timmerman & Jay Jenkins were present to discuss the Extension Board Constitution, Interlocal Agreement with Holt County & UNL and the Interlocal Agreement with Holt & Boyd County for 4-H Assistant position.

Motion by Keyes, 2nd by Paxton, to accept the updated Nebraska Extension Constitution in Holt County. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke.Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Paxton, to accept the Interlocal Agreement with Holt County and UNL Extension. 

Supervisor Keyes withdrew the motion for further review.

Motion by Paxton, 2nd by Keyes, to accept the engineering agreement with Speece Lewis on 472 Avenue, road dam repair C45(561) for $123,190.00 Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None.Motion carried.

Resolution #2023-15 Year-End Certification of County Highway Superintendent. The foregoing resolution was introduced by Supervisor Paxton, who moved its adoption.  Supervisor Keyes seconded the motion. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.  The complete resolution will be printed in the official minutes.

Motion by Paxton, 2nd by Neiman, to purchase a 300 gallon pickup mounted liquid de-icing unit from Warne Chemical & Equipment Company, Inc for $5,268.00. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Paxton, to accept the quote from BlackStrap, Inc for De-Icing for the winter season 2023-2024 at $132.00/ton. Voting Aye: Brenier, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

Road Superintendent Gary Connot presented his Department Activity Report. 

Jake Ryba and Cody Cure with Murphy Tractor & Equipment/John Deere and Eddie Bomar  with NMC/Cat presented the state bid and Sourcewell bid for a new 2024 motorgrader to the Board.

Murphy Tractor: John Deere 772G w/6WD $458,956.00 plus $61,206.29 for service plan = $520,162.29

NMC: Caterpillar 140 15A AWD $436,240.00 plus $58,772.00 for service plan = $495,012.00

The Board recessed from discussion on the motorgrader bids to convene in public hearing. 

11:30 A.M. being the time advertised Chairman Tielke convened a public hearing to receive public comment to consider the addition of a Resolution Opposing Perpetual Land & Water Conservation Easement to the Planning & Zoning Regulations and the Holt County Comprehensive Plan. Planning & Zoning Administrator Marv Fritz was present.

At 11:38 A.M. Motion by Breiner, 2nd by Frahm, to adjourn from public hearing to consider the addition of a Resolution Opposing Perpetual Land & Water Conservation Easement to the Planning & Zoning Regulation and the Holt County Comprehensive Plan. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

Resolution 2023-16 To add the Resolution Opposing Perpetual Land & Water Conservation Easement to the Planning & Zoning Regulation and the Holt County Comprehensive Plan. The foregoing resolution was introduced by Supervisor Frahm, who moved its adoption. Supervisor Neiman seconded the motion. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Motion by Treptow, 2nd by Keyes, to accept the state bid from Murphy Tractor & Equipment on the John Deere 772Gw/6WD for $520,162.29 which will include the service plan. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Beth Ferrell legal counsel with NACO was present to give updates from NACO and state legislative issues. 

Motion by Frahm, 2nd by Neiman, to allow the direct deposit payroll and other related claims. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.



 General Fund Payroll Total: $228,321.63

Road Fund Payroll Total: $152,198.09

  Law Enforcement Fund Claim Total: $3,814.06

The Board recessed for lunch at 12:18 P.M.

Chairman Tielke reconvened the meeting at 1:06 P.M.

At 1:06 P.M. Chairman Tielke convened in Executive Session in regards to a potential real estate purchase.

The Board members, County Clerk and County Attorney were present in closed session.

At 1:37 P.M., Motion by Neiman, 2nd by Paxton, to adjourn from Executive Session and reconvene in Open Session. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Chairman Tielke stated that the only item discussed in closed session was in regards to a potential real estate purchase and no action was taken.

Motion by Keyes, 2nd by Frahm, to appoint Neiman, Breiner and Tielke and County Attorney Kelly to serve on a committee for potential real estate purchase. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

Steve Anson and Mary Reiser with Anson Insurance were present to discuss employee health insurance and Jeanene Conziemius with Meritain Health Insurance was on telephone conference to discuss the renewal of the Employee Health Care Insurance. Motion by Paxton, 2nd by Frahm, to accept the renewal for Employee Health Care Insurance with Meritain Health Insurance and continue with the $50,000.00 self-insurance and remove the Teladoc coverage option for all participants. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.  

Road Foremen Dave Reiman, John Harvey and Jim Roeder  were present to discuss with the Board the continued need of Human Resources for Holt County.

Chairman Tielke adjourned the meeting at 3:26 P.M. until November 16, 2023, at 9:45 A.M.
