The Holt County Board of Supervisors met as a Board of Equalization with all members present. County Assessor Tim Wallinger, County Treasurer Shelly Ross and Deputy County Clerk Janet Sorensen were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943.  Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on October 5, 2023, in the Holt County Independent.

Chairman Frahm convened the meeting at 9:32 A.M. with the flag salute.

Motion by Paxton, 2nd by Neiman, to approve the minutes of the September 29, 2023, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Tielke and Frahm. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Breiner, to approve the tax list corrections #23-020 as submitted by the Assessor. Voting Aye: Keyes, Neiman, Breiner, Paxton, Tielke, Treptow and Frahm. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Keyes, to approve the subdivision levies for 2023-2024. Voting Aye: Neiman, Breiner, Paxton, Tielke, Treptow, Keyes and Frahm. Voting Nay: None. Motion carried.

The Holt County Board of Supervisors met in regular session as per adjournment with all members present. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on October 5, 2023, in the Holt County Independent.

Chairman Tielke convened the meeting at 9:45 A.M. and informed the public of the location of the Open Meeting Poster. 

Motion by Frahm, 2nd by Paxton, to approve the minutes of the September 29, 2023, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

The Treasurer's Report was presented and placed on file.

The Board reviewed claims on file.

Correspondence was reviewed.

Motion by Keyes, 2nd by, Paxton, to approve the Special Designated Liquor License application for Shamrock Nursery Holiday Open House on November 10, 2023. Voting Aye: Keyes, Neiman, Breiner, Paxton, Treptow and Tielke. Voting Nay: None. Motion carried.

Weed Superintendent Bill Babutzke presented his Department Activity Report.

Motion by Treptow, 2nd by Paxton, to appoint Dean Sidak to the Holt County Planning and Zoning Board to represent District #1 to complete the 2023 term. Voting Aye: Keyes, Neiman, Breiner, Paxton, Treptow and Tielke. Voting Nay: Frahm. Motion carried.

Joe Pongratz was present to discuss the snow damage done to his fence.

Planning & Zoning Administrator Marv Fritz presented the recommendation from the Planning & Zoning Commission is to deny the Randall and Tara North Conservation Easement application.

Motion by Frahm, 2nd by Paxton, to set for public hearing on November 16, 2023, at 10:15 A.M. to consider the conservation easement application submitted by Randall M and Tara A North. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried. 



RESOLUTION #2023-014

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

WHEREAS, there has been signed by the COUNTY OF HOLT on the 17th day of June 2019, and the State on the 21st day of June 2019, an agreement providing for the construction of a Federal Aid County Project at the following location: ATKINSON SOUTHEAST, and 

WHEREAS, in the above agreement, the County has pledged sufficient funds to finance its share of the cost of the construction of this project identified as BRO-7045(37), and

WHEREAS, the above mentioned agreement provided that the County will pay costs as set forth in the agreement, and

WHEREAS, the State, on behalf of the County received bids for the construction of this project based on the final plans and specifications on September 28, 2023, at which time 5 bid(s) were received for the construction of the proposed work, and

WHEREAS, the following Contractor(s) for the items of work listed has been selected as the low bidder(s) to whom the contract(s) should be awarded.

DIXON CONSTRUCTION CO., CORRECTIONVILLE, IA 51016-0047

GRADING, CULVERTS, SEEDING, BRIDGE AT STATION 15+00.00, GUARDRAIL, GENERAL ITEMS: $1,397,059.01

NOW THEREFORE, in consideration of the above facts, the HOLT COUNTY BOARD OF SUPERVISORS, by this resolution, takes the following official action:

1. If for any reason the Federal Highway Administration rescinds, limits it obligations, or defers payment of the Federal share of the cost of this project, the County hereby agrees to provide the necessary funds to pay for all cost incurred until and in the event such Federal funds are allowed and paid.

2. The Board hereby concurs in the selection of the above mentioned Contractor(s) for the items of work listed, to whom the contract(s) should be awarded.

3. The Board hereby approves of the final plans and specifications that were used in the bidding process for this project.

4. The Board hereby authorized the Board Chairperson to sign the contract(s) with the above mentioned Contractor(s) for the above mentioned work on behalf of the County using State's standard contract signing process, including when applicable, an electronic or digital signing process such as DocuSign.



The foregoing resolution was introduced by Supervisor Nieman, who moved its adoption. Supervisor Keyes seconded the motion. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

Motion by Neiman, 2nd by Breiner, to approve the Right of Way Permit for Lumen Communications (Century Link) for telephone cable in 1-30-13 & 35-31-13. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke.Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Neiman, to purchase approximately 6000 tons of asphalt millings for $18.00 a ton from Prouty Construction. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

The Finance Committee reported that the County Officials had remitted their monthly fees to the County Treasurer as required.

Murphy Tractor and Equipment were present to discuss a repair quote on a motorgrader and discuss state bid on new motorgrader.

Gary Connot Road Superintendent presented his Department Activity Report.

Motion by Frahm, 2nd by Breiner, to allow the following claims except claim #23100123 for $412.50 to Mary Breiner and claim #2300196 for $1,087.97 to J&S TV. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Frahm, 2nd by Breiner, to allow claim #2310096 for $1,087.97 to J&S TV. Voting Aye: Neiman, Breiner, Paxton, Frahm, Keyes and Tielke.Voting Nay: None. Abstain: Treptow. Motion carried.

At 1:08 P.M., Motion by Breiner, 2nd by Keyes, to adjourn from Executive Session and reconvene in Open Session. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

Chairman Tielke stated that only item discussed in closed session was in regards to collective bargaining and no action was taken.

Chairman Tielke adjourned the meeting at 1:12 P.M. until October 31, 2023, at 9:45 A.M.
