The Holt County Board of Supervisors met as a Board of Equalization with all members present. Deputy County Assessor Montana DeVries, County Treasurer Shelly Ross and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943.  Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on September 5, 2024, in the Holt County Independent.

Chairman Frahm convened the meeting at 9:30 A.M. with the flag salute.

Motion by Paxton, 2nd by Neiman, to approve the minutes of the August 30, 2024, meeting as printed.  Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Tielke and Frahm.  Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Keyes, to acknowledge receipt of the Permissive Exemption list of Real & Personal Property in Holt County.  Voting Aye: Keyes, Neiman, Breiner, Paxton, Tielke, Treptow, and Frahm.  Voting Nay: None. Motion carried.

The Holt County Board of Supervisors met in regular session as per adjournment with all members present. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on September 5, 2024, in the Holt County Independent.

Chairman Tielke convened the meeting at 9:45 A.M. and informed the public of the location of the Open Meeting Poster.

Motion by Neiman, 2nd by Frahm, to approve the minutes of the August 30, 2024, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke.  Voting Nay: None. Motion carried.

The Treasurer's Report was presented and placed on file.

Correspondence was reviewed.  

Claims were reviewed.

The Finance Committee reported that the County Officials had remitted their monthly fees to the County Treasurer as required.

Motion by Breiner, 2nd by Treptow, to approve the surety bonds on file for: Mark Cooper, Orchard Rural Fire Dist #7 Treasurer and Catherine Fuhrer, Holt County Deputy Treasurer. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

9:50 A.M. time was allowed for public comment. Marv Fritz spoke during public comment.

Grace Coleman was present to talk to the Board about the electronic voting machines and return to hand count. 

Chairman Tielke convened a public hearing at 10:17 A.M. to receive public comment on the 2024/2025 Public Hearing to change the tax levy from the prior year, as per published notice. 

No one appeared to comment.

At 10:20 A. M. Motion by Paxton, 2nd by Keyes, to adjourn the Public Hearing to change the tax levy from the prior year and return to regular session. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.



RESOLUTION #2024-12

OF THE

HOLT COUNTY BOARD 

OF SUPERVISORS

WHEREAS, a proposed County Budget for the Fiscal Year July 1, 2024, to June 30, 2025, prepared by the Budget Making Authority, was transmitted to the County Board on the 30th day of August 2024.

NOW THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Holt County, Nebraska as follows:

SECTION 1. That the budget for the Fiscal Year July 1, 2024 to June 30, 2025 as categorically evidenced by the Budget Document and the Budget Message be, and the same hereby is, adopted as the Budget of Holt County for said fiscal year.

SECTION 2. That the offices, departments, activities and institutions herein named are hereby authorized to expend the amounts herein appropriated to them during the fiscal year beginning July 1, 2024, and ending June 30, 2025.

SECTION 3. That the income necessary to finance the appropriations made and expenditures authorized shall be provided out of the unencumbered cash balance in each fund, revenues other than taxation to be collected during the fiscal year in each fund, and tax levy requirements for each fund.

SECTION 4. The Holt County Board of Supervisors approve exceeding the restricted funds authority for the fiscal year 2024-2025 by an additional 1%.



The foregoing resolution was introduced by Supervisor Paxton, who moved its adoption. Supervisor Frahm seconded the motion. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried



RESOLUTION #2024-13

OF THE

HOLT COUNTY BOARD 

OF SUPERVISORS

WHEREAS, Nebraska Revised Statute 77-1632 and 77-1633 provide that the Governing Body of the County of Holt passes by a majority vote a resolution setting the tax request; and

WHEREAS, a special public hearing was held as required by law to hear consider comments concerning the property tax request; and

NOW, THEREFORE, the Governing Body of the County of Holt, by a majority vote, resolves that:

1. The 2024-2025 property tax request be set at General Fund $10,750,000.00.

2. The total assessed value of property differs from last year's total assessed value by 14 percent.

3. The tax rate which would levy the same amount of property taxes as last year, when multiplied by the new total assessed value of property would be 0.311521 per $100 of assessed value.

4. Holt County proposes to adopt a property tax request that will cause its tax rate to be 0.306326 per $100 of assessed value.

5. Based on the proposed property tax request and changes in other revenue, the total operating budget of Holt County will increase last year's budget by 9 percent.

6. A copy of this resolution be certified and forwarded to the State Auditor on or before October 20, 2024.



The foregoing resolution was introduced by Supervisor Paxton, who moved its adoption. Supervisor Frahm seconded the motion. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

10:30 A.M. being the time advertised, Chairman Tielke convened a public hearing to receive public comment to review and act on the Application for Conditional Use Permit filed by VRDG, LLC for a Commercial Solar Conversion System in Knox and Holt County. 17 interested people were present for the hearing. Those speaking were: Dick Wallace, Rollie Pudenz, Neva Doerr, Dan Doerr, Jeff Uhlir, Matt Robinette, Blue Stem Energy Systems and David Levy, Baylor-Evnen. Letters of support were received from Jeff Uhlir and Richard McElhaney.

Motion by Paxton, 2nd by Neiman, to adjourn from public hearing at 11:05 A.M. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Keyes, to accept the recommendation from the Holt County Planning and Zoning Commission and approve the issuance of a Conditional Use Permit for VRDG, LLC for a Commercial Solar Conversion System in Knox and Holt County with the following additions and conditions: 

1. VRDG, LLC obtains all required State and Federal Permits for the described project, physical construction will not occur prior to this permit becoming effective. 

2. VRDG, LLC has finalized any necessary road hauling agreement.

3. The Emergency Response and Hazardous Waste Plan has been approved and signed by the Emergency Management Official for Holt County.

4. The applicant is to post a bond for decommissioning instead of a letter of credit under the terms of Holt County's CUP application process.

Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton and Tielke.  Voting Nay: Frahm. Motion carried.

Motion by Frahm, 2nd by Neiman, to allow the following claims except claim #24090050 for $117.59 to J&S TV & Electronics.  Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Neiman, 2nd by Paxton, to purchase a LCG84 tree grapple for $6,910.00 from NMC Cat. Voting Aye: Paxton, Treptow, Keyes, Neiman, Breiner and Tielke.  Voting Nay: Frahm.  Motion carried.

Motion by Keyes, 2nd by Neiman, to repair the 2014 CAT motorgrader to include motor and transmission for $100,217.73 with 3 year/5000 hour warranty. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke.  Voting Nay: None.  Motion carried.

Motion by Frahm, 2nd by Breiner, to set bid date for C45(563) Superstructure Replacement for October 16, 2024, at 11:00 A.M. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Gary Connot Road Superintendent presented his Department Activity Report.

Motion by Frahm, 2nd by Keyes, to authorize the Chairman to sign the contract approval for Holt County CBMP(7) C004509505(449).  Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried. 

Chairman Tielke adjourned the meeting at 12:38 P.M. until September 30, 2024 at 9:45 A.M.
