A regular meeting of the Mayor and the City Council of O'Neill was held at the City Hall in said City on the 8th day of September, 2025 at 6:30 P.M. Present: Mayor Scott Menish, City Clerk/Treasurer Sarah Sidak, City Attorney Boyd Strope, Council President Quana Wheeler and Council members; Kayla Burdick, Michelle Liewer, Tim Gleason and Beth Walsh. Absent: Council members Tim Schneider, Paul Asche and Chris Laursen. Notice of this meeting was given in advance thereof according to Section 84-1408 of the Revised Statutes of Nebraska. Notice of the meeting was given to the Mayor and all members of the Council and a copy of the acknowledgement of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice. All proceedings hereafter shown were taken while convened meeting was open to the attendance of the public. The meeting was called to order by Mayor Scott Menish. The Pledge of Allegiance was recited. Mayor Menish informed the public of the location of the Open Meetings Act poster. Moved by Gleason, second by Liewer to waive the reading of the minutes of the August 4th, 11th and 26th meetings and approve them as if read. Roll call vote as follows: Aye; Wheeler, Liewer, Gleason and Walsh. Nay: Burdick. Absent: Asche, Laursen and Schneider. Motion carried. Natalie Butterfield with the Fenian Women's Auxiliary talked with the Council about the importance of keeping the Shamrock green and not painting it a different color. The Council advised Natalie to work with Bright Horizons and see if they can come up with a compromise and bring it back to the Council on the September 16th special meeting. Moved by Walsh, second by Wheeler to open the public hearing for the McDonald minor subdivision request for property located at 49402 US HWY 20. Roll call vote as follows: All Ayes. Motion carried. Council member Walsh informed the board that the Planning Commission had met at noon and approved the subdivision as submitted. No public comment was made. Moved by Walsh, second by Burdick to close the public hearing for the McDonald minor subdivision request for property located at 49402 US HWY 20. Roll call vote as follows: All Ayes. Motion carried. Moved by Gleason, second by Walsh to approve the minor subdivision request from McDonald as submitted. Roll call vote as follows: All Ayes. Motion carried. No discussion or action was taken on the street/water projects – questions/concerns on 2nd Street, Cemetery, water lines and snow removal due to no one being there for the agenda item. Council member Gleason introduced Resolution No. 25-08, which is on file with the City Clerk. RESOLUTION NO. 25-08 OF THE CITY OF O'NEILL WHEREAS: State of Nebraska Statutes, sections 39-2115, 39-2119, 39-2120, 39-2121 and 39-2520(2), requires an annual certification of program compliance to the Nebraska Board of Public Roads Classifications and Standards; and WHEREAS: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each municipality shall be signed by the Mayor or Village Board Chairperson and shall include the resolution of the governing body of the municipality authorizing the signing of the certification. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF O'NEILL, NEBRASKA; that the Mayor is hereby authorized to sign the attached Municipal Annual Certification of Program Compliance.
