A regular meeting of the Mayor and the City Council of O'Neill was held at the City Hall in said City on the 8th day of May, 2023 at 6:30 P.M.

Present: Mayor Scott Menish, City Clerk/Treasurer Sarah Sidak, Council President Tim Schneider and Council members; Susie Kramer, Kayla Burdick, Paul Asche, Quana Wheeler, Beth Walsh and Tim Gleason. Absent: City Attorney Boyd Strope and Council member Michelle Liewer.     

Notice of this meeting was given in advance thereof according to Section 84-1408 of the Revised Statutes of Nebraska. Notice of the meeting was given to the Mayor and all members of the Council and a copy of the acknowledgement of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance  notice. All proceedings hereafter shown were taken while convened meeting was open to the attendance of the public.

The meeting was called to order by Mayor Scott Menish. The Pledge of Allegiance was recited. Mayor Menish informed the public of the location of the Open Meetings Act poster.

Moved by Schneider, second by Walsh to waive the readings of the minutes of the April 3rd meeting and approve them with the amended motion regarding the approval of the PIP-LB840-147 as follows:

Moved by Wheeler, second by Kramer to approve PIP-LB840-147 for new windows and door in the amount of $10,000.00.  Roll call vote as follows: Aye; Asche, Wheeler, Kramer, Schneider, Liewer, Gleason and Walsh. Nay: None. Abstain: Burdick. Motion carried.

Roll call vote as follows:  All Ayes. Motion carried.

Mayor Menish called for all hay bids.

City Clerk Sidak read the following bid aloud:

• Jason Maloun $300.00

Moved by Burdick, second by Walsh to accept the hay bid submitted by Jason Maloun for $300.00. Roll call vote as follows:  All Ayes. Motion carried.

Moved by Burdick, second by Walsh to open the public hearing for the Gregory A. Vanevery DBA I Don't Care Bar and Café LLC Class I Liquor License request. Roll call vote as follows: All Ayes. Motion carried.

No public comment was made.

Moved by Burdick, second by Walsh to close the public hearing.Roll call vote as follows: All Ayes.Motion carried.

Moved by Asche, second by Gleason to approve the Class I Liquor License request by Gregory A. Vanevery DBA I Don't Care Bar and Café LLC. Roll call vote as follows: All Ayes. Motion carried.

City Clerk Sidak read the following 1st Street/John Street and 8th Street bids aloud:

• A&R Construction $1,144,114.23

• Myers Construction $1,999,876.23

City Engineer Dave Olsson opened the bids prior to the meeting and after review recommends accepting the bid submitted by A&R Construction for $1,144,114.23.

Moved by Gleason, second by Asche to approve the bid submitted by A&R Construction for $1,144,114.23. Roll call vote as follows:  Aye; Asche, Wheeler, Kramer, Schneider, Gleason and Walsh. Nay: Burdick. Absent Liewer. Motion carried.

Motion by Burdick, second by Wheeler to allow Three River to attach a small satellite dish to a pole that will be installed on the South side of the Community Center that will allow credit card services to be used in the Community Center parking lot and Carney Park. Roll call vote as follows: All Ayes. Motion carried.

Moved by Wheeler, second by Walsh to approve PIP-LB840-153 for new windows and siding in the amount of $6,288.31. Roll call vote as follows:  All Ayes. Motion carried.

Moved by Walsh, second by Asche to approve the performance evaluation and compensation guidelines submitted by the wage committee. Roll call vote as follows: Aye; Asche, Wheeler, Kramer, Schneider, Gleason and Walsh. Nay: Burdick. Absent Liewer. Motion carried.

City Clerk Sidak informed the Council that they are in the process of changing software programs in the office. They are hoping for a smooth transition to take place in the fall.  

Moved by Schneider, second by Gleason to approve Treasurer's Report. Roll call vote as follows:  All Ayes. Motion carried.

Moved by Wheeler, second by Schneider to approve the bill submitted at this meeting by Scott Menish. Roll call vote as follows: All Ayes. Motion carried.

Moved by Walsh, second by Gleason to approve the bill submitted at this meeting by O'Neill Lumber. Roll call vote as follows:  Aye; Asche, Wheeler, Kramer, Burdick, Gleason and Walsh. Nay: None. Abstain: Schneider. Absent: Liewer. Motion carried.

Moved by Wheeler, second by Asche to approve the remaining bills. Roll call vote as follows: All Ayes.Motion carried.
