A regular meeting of the Mayor and the City Council of O'Neill was held at the City Hall in said City on the 4th day of December, 2023 at 6:30 P.M.

Present: Mayor Scott Menish, City Clerk/Treasurer Sarah Sidak, City Attorney Boyd Strope, Council President Tim Schneider and Council members; Kayla Burdick, Michelle Liewer, Susie Kramer, Paul Asche, Tim Gleason and Beth Walsh. Absent: Quana Wheeler.  

Notice of this meeting was given in advance thereof according to Section 84-1408 of the Revised Statutes of Nebraska. Notice of the meeting was given to the Mayor and all members of the Council and a copy of the acknowledgement of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice. All proceedings hereafter shown were taken while convened meeting was open to the attendance of the public.

The meeting was called to order by Mayor Scott Menish. The Pledge of Allegiance was recited. Mayor Menish informed the public of the location of the Open Meetings Act poster.

Moved by Kramer, second by Asche to waive the readings of the minutes of the November 6th meeting and approve them as if read. Roll call vote as follows: All Ayes. Motion carried.

The Council tabled and did not take any action on adjusting tipping fees along HWY 275 frontage.

Moved by Schneider, second by Burdick to approve Christopher Kizzire for the Ambulance and Fire Department.  Roll call vote as follows: All Ayes. Motion carried.

The Council tabled until the next meeting the possibility of selling the old wellhouse property at Kipples Trailer Court and the old water tower property located at 4th Street and John Street to get the appraisals and decide how much to ask for each property.

Moved by Schneider, second by Kramer to approve application PIP-LB840-166 for $5,342.18 for a sign and remodel. Roll call vote as follows: All Ayes. Motion carried.

City Clerk Sidak read the following Municipal Water Improvements Phase 1C bids aloud:

• Rutjens Construction — $509,058.00

• Van Kirk Bros Contracting — $799,366.20

City Engineer Dave Olsson opened the bids prior to the meeting and after review recommends accepting the bid submitted by Rutjens Construction for $509,058.00.

Moved by Walsh, second by Gleason to approve the bid submitted by Rutjens Construction for $509,058.00. Roll call vote as follows: All Ayes. Motion carried.

Moved by Kramer, second by Schneider to approve the renewal agreement with Olsson & Associates for professional services. Roll call vote as follows: All Ayes. Motion carried.

Moved by Schneider, second by Walsh to open the public hearing for the City's purchasing of property at the following location: O'NEILL VI; PIONEER TOWNSITE CO ADD BLOCK 2 LOTS 1-2-3-4-5 AND O'NEILL VI; TRACKS ALONG R.R. PT OF SE ¼ SW ¼ 30-29-11.  Roll call vote as follows: All Ayes. Motion carried.

No public comment was made.

Moved by Walsh, second by Kramer to close the public hearing.  Roll call vote as follows: All Ayes. Motion carried.

Moved by Schneider, second by Liewer to approve the purchase of the following property owned by Ken Musil: O'NEILL VI; PIONEER TOWNSITE CO ADD BLOCK 2 LOTS 1-2-3-4-5 AND O'NEILL VI; TRACKS ALONG R.R. PT OF SE ¼ SW ¼ 30-29-11. Roll call vote as follows: All Ayes. Motion carried.

City Attorney Strope informed the Council that he has a letter drafted that the cities and villages of Holt County will sign and send to Boyd/Holt E911 Board.
