A regular meeting of the Mayor and the City Council of O'Neill was held at the City Hall in said City on the 4th day of March, 2024 at 6:30 P.M. Present: Mayor Scott Menish, City Clerk/Treasurer Sarah Sidak, City Attorney Boyd Strope, Council President Tim Schneider and Council members; Kayla Burdick, Michelle Liewer, Quana Wheeler, Paul Asche, Susie Kramer and Beth Walsh. Absent: Council member Tim Gleason. Notice of this meeting was given in advance thereof according to Section 84-1408 of the Revised Statutes of Nebraska. Notice of the meeting was given to the Mayor and all members of the Council and a copy of the acknowledgement of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice. All proceedings hereafter shown were taken while convened meeting was open to the attendance of the public. The meeting was called to order by Mayor Scott Menish. The Pledge of Allegiance was recited. Mayor Menish informed the public of the location of the Open Meetings Act poster. Moved by Liewer, second by Burdick to waive the readings of the minutes of the February 5th meeting and approve them as if read. Roll call vote as follows: All Ayes. Motion carried. City Attorney Strope explained to the Council that Police Chief Otte and himself would like to add to Section 2-603: Abatement the option that a citation could be issued immediately. Council member Schneider introduced Ordinance No. 1423, which is on file with the City Clerk. City Attorney Strope read Ordinance No. 1423 by title and number. ORDINANCE NO. 1423 OF THE CITY OF O'NEILL, NEBRASKA AN ORDINANCE OF THE CITY OF O'NEILL, NEBRASKA, AMENDING SECTION 2 -603: ABATEMENT; REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF O'NEILL, NEBRASKA, that: Sec. 1. Section 2-603: ABATEMENT of the O'Neill Municipal Code be amended to read as follows: “SECTION 2-603: ABATEMENT Whenever the city police or code enforcement officer determines that a nuisance is being maintained within the City the following action shall be taken at the discretion of the officer: 1. A citation immediately issued; OR 2. The police chief or city attorney shall cause written notice to be served by registered mail or by personal service upon the owner or occupant of the property on which the nuisance is located. If notice by personal service or certified mail is unsuccessful, notice shall be given by publication in a newspaper of general circulation in the City or by conspicuously posting the notice on the lot or ground upon which the nuisance is to be abated or removed. Such notice shall state the type of nuisance located on the property and shall provide that such nuisance shall be abated or removed within ten days of receipt of such notice or publication or posting, whichever is applicable. Council member Schneider introduced Resolution No. 24-04, which is on file with the City Clerk. RESOLUTION NO. 24-04 OF THE CITY OF O'NEILL, NEBRASKA WHEREAS, Section 39-2115 and Section 39-2119, 1969, C.S.-R.S. of Nebraska 1943 requires that each County and Municipality prepares a one and six year, specific road or street improvement plan and WHEREAS, the Mayor and City Council of the City of O'Neill in compliance with the statutes and regulations of the State Highway Commission, did hold a public hearing on that proposed one and six year specific street improvement plans in the City Hall on March 4, 2024, in accordance with the "Notice of Public Hearing," a certified copy of such notice is attached, and WHEREAS, there were no objections filed with the City Clerk and as presented at the hearing now, WHEREAS, there were no amendments made to the one and six year plan on file with the City Clerk and as presented at the hearing now, THEREFORE BE IT RESOLVED, that the City Council does hereby approve said one and six year plan, as filed with the City Clerk, a copy of which is attached hereto, BE IT FURTHER RESOLVED, that the Mayor of the City is authorized to sign this resolution on behalf of the City Council and City Council hereby approves the proposed one and six year plan. Motion carried. The Council did not take any action on adjusting the dog impound fees. City Attorney Strope will work on drafting a policy concerning fixing mailboxes due to damage from snow removal. ORDINANCE NO. 1424 OF THE CITY OF O'NEILL, NEBRASKA AN ORDINANCE OF THE CITY OF O'NEILL, NEBRASKA, CONFIRMING THE SALE OF REAL ESTATE AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF O'NEILL, NEBRASKA, that: Sec. 1. On the 8th day of January, 2024, Resolution No. 24-02 was passed finding the below described Real Estate is no longer needed for City purposes, setting forth the terms of sale, and sale of the Real Estate is in the best interest of the City. Sec. 2. Notice of the proposed sale has been published as required by law in the Holt County Independent. Sec. 3. There have been no objections to said sale filed with the City within the 30 day right of remonstrance period. Sec. 4. The sale of the following described Real Estate: Commencing at the northwest corner of Block Forty-Six (46) in McCafferty's Addition to O'Neill, Holt County, Nebraska, running thence South Eighty Feet (S80'); running thence East One Hundred Thirty-Two Feet (E132'); running thence North Eighty Feet (N80'); running thence West One Hundred Thirty-Two Feet (W132') to the place of beginning, being the north Eighty Feet (N80') of Lot Six (6) in said Block 46 of McCafferty's Addition to O'Neill, including the West Half of the North 80 Feet of the vacated adjoining alley is hereby confirmed to Clint Zastrow as purchaser for the sum of $4,276.00.
