The Holt County Board of Supervisors met as a Board of Equalization with all members present. County Assessor Tim Wallinger, County Treasurer Shelly Ross and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943.  Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on November 7 , 2024, in the Holt County Independent.

Chairman Frahm convened the meeting at 9:30 A.M. with the flag salute.

Motion by Neiman, 2nd by Breiner, to approve the minutes of the October 31, 2024, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Tielke  and Frahm. Voting Nay: None. Motion carried.

Chairman Frahm adjourned the meeting at 9:38 A.M.

The Holt County Board of Supervisors met in regular session as per adjournment with all members present. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on November 7, 2024, in the Holt County Independent.

Chairman Tielke convened the meeting at 9:45 A.M. and informed the public of the location of the Open Meeting Poster.  

Motion by Frahm, 2nd by Keyes, to approve the minutes of the October 31, 2024, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

The Board reviewed claims on file.

The Treasurer's Report was presented and placed on file.

Motion by Frahm, 2nd by Breiner, to acknowledge the receipt of the Distress Warrant Report for 2023 on 49 warrants with a total of $26,872.74 and has been issued and given to the Holt County Sheriff on November 1, 2024. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

9:50 A.M. being the time advertised time was allowed for public comment.  Shelby Regan Holt County Economic Development and Marv Fritz Holt County Planning & Zoning Administrator were present to speak. Motion by Neiman, 2nd by Treptow, to appoint John Vogel to the Holt County Planning and Zoning Board to represent District #7 and to complete the 2025 term. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None.  Motion carried.

Motion by  Frahm, 2nd by Paxton, to acknowledge receipt of the Countywide Cost Allocation Plan as completed by Maximus Consulting Services. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None.  Motion carried.

Motion by Keyes, 2nd by Breiner, to approve the surety bond for Joshua Treptow, Holt County Supervisor. Voting Aye: Paxton, Frahm, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Abstain: Treptow. Motion carried.

Motion by Frahm, 2nd by Keyes, to approve the zoning application for Michael and Mary Pospichal on a tract in SE ¼ 7-26-14. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

The Finance Committee reported that the County Officials had remitted their monthly fees to the County Treasurer as required.

Motion by Frahm, 2nd by Paxton, to allow the following claims except claim #24110043 for $$1,855.00 to J&S TV & Electronics. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

RESOLUTION #2024-15

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

Whereas: (Holt) County and State entered into an LPA Program Agreement for State to assist County in the development and construction of an LPA Federal-aid transportation project;

Whereas: The project construction has been tentatively accepted and the State, on LPA's behalf, has recommended that the project is ready for final acceptance;

Whereas: The LPA Program Agreement requires the county to review and formally approve State's recommendation that the project is ready for final acceptance;

Whereas: County has reviewed the State's recommendation and agrees that the project has been constructed according to the plans, specifications and any change order(s) and that the construction is ready for final acceptance;

Whereas: County believes that the traffic control and permanent signs on the project are appropriate, have been properly placed and are acceptable to the County.

Be It Resolved by the County Board of (Holt) County that:

The Chair, (William Tielke), is hereby authorized to sign the bottom of this resolution and submit it to the State signifying the County's final acceptance of the project construction.

The permanent signing and traffic control on the project are appropriate, have been properly placed and are acceptable to County.  The County hereby accepts maintenance of the project and agrees to meet all environmental and other commitments related to the project.

The foregoing resolution was introduced by Supervisor Neiman, who moved its adoption. Supervisor Paxton seconded the motion. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Breiner, to approve the Right of Way permit for Paul Bartak for drainage pipe in NE ¼ 35-25-9. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None.  Motion carried.

Motion by Keyes, 2nd by Frahm, to direct the County Clerk to certify road mowing charges to the County Treasurer, for collection, as submitted by the Road Superintendent. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Frahm, to accept the revised start date on project C45(449) Ewing Southeast to be December 9, 2024. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

11:00 A.M. being the time advertised “Proposals for Professional Engineering Consulting Services were received. The proposals were reviewed by the Holt County Board. 

Proposals were received from:  Speece Lewis, a Bowman Company

The board reviewed the proposal by Speece Lewis to ensure that it met their selection criteria:

1. Professional Qualifications

2. Specialized Experience and Technical Competence in the type of work required.

3. Past Performance

4. Adequate Staff

5. Consultant Proximity to County

6. Familiarity with County, County Personnel, and County Procedures.

The board concluded that Speece Lewis had demonstrated through past performance that they met the desired selection criteria.

Motion by Keyes, 2nd by Paxton, to enter into a contract with Speece Lewis for Professional Engineering Consulting Services for a two-year term. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Motion by Breiner, 2nd by Treptow, to set bid date for C45(564) for bridge repair materials on December 16, 2024, at 11:00 A.M. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Treptow, to approve the skid steer lease with NMC on a CAT 299D3XE for $10,800.00 for 1 year or 250 hours. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Breiner, to purchase a Wheel Loader from Murphy Tractor through the Sourcewell bid contract on a 2024 John Deere 644G for $299,980.00 which includes the autolube system and the enhanced maintenance plan. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Neiman, to consign the surplus materials to local consignment auction and consign the following surplus equipment 2003 Deere 644H Wheel Loader, 2016 Deere 772G Motorgrader, 2015 CAT 12M2 Motorgrader and a 2010 CAT 140M Motorgrader to auction with Pavel Auction Service through Auction Time online auction. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

Gary Connot Road Superintendent presented his Department Activity Report.

The Board recessed for lunch at 12:06 P.M.
