NOTICE OF TRUSTEE'S SALE 

You are hereby notified that the following property will be sold at public auction to the highest bidder without warranty, by Eric H. Lindquist, Successor Trustee, on September 9, 2026 at on the first floor of the Holt County Courthouse, 204 N. 4th St., #3, O'Neill, NE 68763, at 10:00 AM for the purpose of foreclosing a Trust Deed executed by Allison Nachtman and Austin Nachtman, Husband and Wife, as Trustors, in favor of Mortgage Electronic Registration Systems, Inc., as Beneficiary, as nominee for CrossCountry Mortgage, LLC, its successors and assigns as Beneficiary, and Chicago Title Insurance Company as Trustee. The Trust Deed was filed for record on November 27, 2023, as Instrument No. 2023-01826, in Book 448, at Page 394. The trust property affected is legally described as follows. Lot 3 and the North 10 feet of Lot 4, in Block 46, of Pioneer Town Site Company's First Addition to Atkinson, Holt County, Nebraska.  TAX # 0450021135. Purportedly known as 208 N Hyde St, Atkinson, NE 68713 (the undersigned disclaims liability for any error in the address). PennyMac Loan Services, LLC is the current Beneficiary of the Trust Deed.  Record owners of the property as of the recording of the Notice of Default is reported to be Allison Nachtman and Austin Nachtman. The highest bidder will deposit with the Trustee, or the attorney for the Trustee, a $5,000.00 deposit in the form of a bank or credit union cashier's check or a bank official check, payable to Halliday, Watkins & Mann, P.C.  The successful bidder must tender the deposit at the sale and the balance of the purchase price by 12:00 noon the following business day.  The balance must be in the form of a wire transfer, bank or credit union's cashier's check, or bank official check payable to Halliday, Watkins & Mann, P.C. A bank or credit union cashier's check must be pre-printed and clearly state that it is a cashier's check.  A bank official check must be pre-printed and clearly state that it is an official check. Any party who wants to bid at the Trustee's Sale must display the check described above prior to submitting a bid. The requirement is waived when the Beneficiary is the highest bidder. Successor Trustee disclaims liability for any error in the street address shown herein. Successor Trustee may void sale due to any unknown facts at time of sale that would cause the cancellation of the sale. If sale is voided, Successor Trustee shall return funds to bidder, and the Successor Trustee and Beneficiary shall not be liable to bidder for any damages. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Beneficiary, Trustor, Successor Trustee, or the Successor Trustee's attorney.  This is an attempt to foreclose a security instrument and any information obtained will be used for that purpose. ORDINANCE NO. 1443

 OF THE

CITY OF O'NEILL, 

NEBRASKA

AN ORDINANCE OF THE CITY OF O'NEILL, NEBRASKA, CONTINUING THE CITY'S ECONOMIC DEVELOPMENT PROGRAM, CONTINUING A SALES AND USE TAX OF ONE-HALF PERCENT (½%) TO BE APPROPRIATED TO THE ECONOMIC DEVELOPMENT PROGRAM; REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF O'NEILL, NEBRASKA, that:

Sec. 1. On May 12, 2026 at the Primary Election, a majority of the qualified electors of the City voting at the election, passed the following propositions which were submitted on the ballot at the election:

A. The City of O'Neill shall continue its Economic Development Program by appropriating annually from local sources of revenue a one-half percent (½%) sales and use tax which will generate funds not to exceed 0.4 of the one percent of the City's valuation for 15 years.

B. The governing body of the City shall impose a sales and use tax of one-half percent (½%) upon the same transactions within the City of O'Neill on which the State of Nebraska is authorized to impose tax, with the proceeds of one-half percent (½%) being allocated to fund the O'Neill Economic Development Program beginning October 1, 2027 and ending of September 30, 2042.

Sec. 2. The City's Economic Development Plan previously adopted shall continue in full force and effect until September 30, 2042.

Sec. 3. Beginning October 1, 2027 and ending September 30, 2042 the City shall impose a sales and use tax of one-half percent (½%) upon the same transactions within the City on which the State of Nebraska is authorized to impose a tax, with the proceeds being allocated to fund the City's Economic Development Program.

Sec. 4. That all prior ordinances in conflict herewith are repealed as of the effective date of this Ordinance.

Sec. 5. That this ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law.
