Notice is hereby given that on August 23, 2024, Greg Jorgensen and Amy Jorgensen, as Plaintiffs, filed a Complaint and commenced an action in the District Court of Holt County, Nebraska at CI24-80, against the above named Defendants, all other persons or entities, real names unknown, having any right, title or interest in

Lots 1 and 2 of Block 33 in the  subdivision entitled blocks 28 to 33 inclusive to the town of Ewing, Holt  County, Nebraska, AND that part of Outlot “A” in the sub-division entitled Outlots and Pioneer Town site Companies First Addition to the town  of Ewing, bounded as follows: On  the north by a line parallel with and distance north 180 feet from the north line of Jackson Street, on the east by the west line of Pine Street extended north, on the south by the said north line of Jackson Street and on the west by a line parallel with and distant west 150 feet from said extended west line of Pine Street as said outlot is laid down and described on the plat of said  subdivision of said town. as Defendants, the object and prayer of which  is to foreclose a certain Certificate of Tax Sale issued by the Treasurer of Holt County, Nebraska on the Property which was sold at public sale on December 4, 2020, and identified as County Treasurer's Certificate of Tax  Sale No. 010281. The Plaintiffs are the current owner and holder of said  Certificate of Tax Sale.

The Plaintiffs allege in the Complaint that there is now due the Plaintiffs on said Certificate of Tax Sale the original amount of said Certificate of Tax Sale in the sum of $6,208.64, plus all subsequent taxes that the Plaintiffs have paid together with interest upon such original sum and additional sums as may be paid by the Plaintiffs at the rate of 14.00% per annum from and after the date(s) of delinquency thereof, costs and attorney fees.

The Plaintiffs pray that in default of payment by the Defendants of the amount due the Plaintiffs as aforesaid, the Property be decreed to be sold according to law to satisfy the sums found due to the Plaintiffs, with interest, costs of suit, and attorney fees, and that such Defendants be forever barred and foreclosed of all right, title, lien, equity of redemption or other interest in, to and upon the Property.

You are required to answer such Complaint on or before the 8th day of March, 2025.

IX. INDEMNIFICATION. The Company shall indemnify an individual made a party to any proceeding that results from his or her relationship as a manager, officer, organizer, employee or agent of the Company against liability incurred in the proceeding if:

A. He/she conducted himself/herself in good faith

B. He/she reasonably believed that his/her conduct was in or at least not opposed to the Company's best interest and

C. In the case of any criminal proceeding, he/she had no reasonable cause to believe his/her conduct was unlawful.

Indemnification shall also be provided for an individual's conduct with respect to an employee benefit plan if the individual reasonably believed his/her conduct to be in the interests of the participants in and beneficiaries of such plan.

The Company shall pay for or reimburse the reasonable expenses incurred by a manager, officer, organizer, employee, or agent of the Company who is a party to a proceeding in advance of final disposition of the proceeding if:

A. The individual furnishes the Company with a written affirmation of his/her good faith belief that he/she has met the standard of conduct described herein

B. The individual furnishes the Company a written undertaking executed personally or on his behalf to repay the advance if it is ultimately determined that he/she did not meet the standard of conduct and

C. A determination is made that the facts then known to those making the determination would not preclude indemnification under the law. The undertaking required by this paragraph shall be an unlimited general obligation, but need not be secured and may be accepted without reference to financial ability to make repayment.

The indemnification and advance of expenses authorized herein shall not be exclusive to any other rights to which any manager, officer, organizer, employee or agent may be entitled under any bylaw, agreement, and vote of members or disinterested managers or otherwise. The Certificate of Organization shall not be interpreted to limit in any manner the indemnification or right to advancement for expenses of an individual who would otherwise be entitled thereto.

These Certificate of Organization shall be interpreted as mandating indemnification and advancement of expenses to the extent permitted by law.

In addition to the foregoing, the Company shall indemnify and save the organization harmless for all acts taken by them as organizers of the Company, and shall pay all costs and expenses incurred by or imposed upon them as a result of the same, including compensation based upon the usual charges for expenditures required of them in pursuit of the defense against any liability arising on the account of acting as organizers or on the account enforcing the indemnification right hereunder, and the Company releases them from all liability for any such act as organizers not involving willful or grossly negligent misconduct.

X. PREEMPTIVE RIGHTS. The members of the Company have preemptive rights only in the manner specified in the Operating Agreement.

ORDINANCE NO. 1428

OF THE

CITY OF O'NEILL, 

NEBRASKA

AN ORDINANCE OF THE CITY OF O'NEILL, NEBRASKA, AMENDING SECTION 1-1501 OF THE O'NEILL MUNICIPAL CODE REGARDING POLICE DEPARTMENT APPOINTMENT AND DUTIES; REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF O'NEILL, NEBRASKA, that:

Sec. 1.  Section 1-1501: DUTIES of the O‘Neill Municipal Code be amended to read as follows:

SECTION 1-1501: APPOINTMENT AND DUTIES

(A) The mayor, with the consent of the city council, may appoint such officers as shall be required by ordinance or otherwise required by law. Such officers may be removed from office by the mayor, with the consent of the city council. The terms of office for all officers, except regular police officers, appointed by the mayor and confirmed by the city council shall be established by the city council by ordinance. The ordinance shall provide that either (a) the officers hold the office to which they have been appointed until the end of the mayor's term of office and until their successors are appointed and qualified unless sooner removed or (b) the officers hold office for one year unless sooner removed.

(B) The mayor, by and with the consent of the city council, shall appoint such a number of regular police officers as may be necessary. All police officers appointed by the mayor and city council may be removed, demoted, or suspended at any time by the mayor as provided in the City's Police Employee Manual and Nebraska Statutes. A police officer, including the chief of police, may appeal to the city council such removal, demotion, or suspension with or without pay. After a hearing, the city council may uphold, reverse, or modify the action.

(C) The chief of police shall, subject to the direction of the mayor, have control and management of all matters relating to the Police Department, its officers and members, and shall have the custody and control of all property and books belonging to the Department. The Department shall execute and enforce all laws and also the orders of the mayor. It shall be the duty of the Department to protect the rights of persons and property. There shall be a proper police force at all fires. The Department shall take notice of all nuisances, impediments, obstructions and defects in the streets, avenues, alleys, business places and residences of the City. The Department shall execute or cause to be executed the processes issued and shall cause all persons arrested to be brought before the proper court for trial as speedily as possible. The chief of police and all regular and special police officers shall become thoroughly conversant with the laws of the City, shall see that the same are strictly enforced and shall make sworn complaints against any person or persons for violation of the same.” 

Sec.  2. That all prior ordinances in conflict herewith are repealed.

Sec.  3.  That this ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law.

ORDINANCE NO. 1429

OF THE

CITY OF O'NEILL, 

NEBRASKA

AN ORDINANCE OF THE CITY OF O'NEILL, NEBRASKA, AMENDING SECTION  6-408 OF THE O'NEILL MUNICIPAL CODE REGARDING GARBAGE AND REFUSE COLLECTION FEES; REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF O'NEILL, NEBRASKA, that:

Sec. 1. Section 6-408 of the O'Neill Municipal Code be amended to read as follows:

“SECTION 6-408: COLLECTION FEES 

RESIDENTIAL. Each residence will be charged the sum of $17.69 per month for refuse collection or $21.22 with cart, except residences that qualify for the senior citizen rate. Residents 65 years of age or older who live by themselves and residents 70 years of age and living with only one other person shall be eligible for the senior discount and will be charged the sum of $14.15 per month. All senior citizens eligible for the discount rate shall be required to sign a certificate qualifying them for such rates. When a resident signs up for the discount plan, the same will not go into force and effect until the next month.

COMMERCIAL. Each commercial account will be charged according to the following rate schedule per month for refuse collection, except those that qualify for the small business discount plan:

Any small business not having a dumpster and not generating more than six (6) standard garbage bags per week of garbage shall be entitled to a small business rate of $37.72 per month.  All small businesses shall be required to sign a certificate qualifying them for such rates. When a small business signs up for the small business rate, the same shall not go into force and effect until the next month. At sites where there are both commercial and residential accounts, the commercial charge has priority and will be the only charge levied. Payments to utility bills will be applied under a priority system, paying garbage first, sewer second and water last. Delinquent fees shall cause discontinuance of service under the same procedures set forth in the municipal code for water and sewer disconnection. Any person whose service has been discontinued and allows garbage to collect can be prosecuted under the city nuisance ordinances.

EFFECTIVE DATE.  The above rates shall become effective February 1, 2025.

Sec.  2. That all prior ordinances in conflict herewith are repealed.

Sec.  3. That this ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law.

NOTICE OF PUBLIC 

HEARING

The Holt County Board of Supervisors has scheduled a public hearing for the One and Six Year Road Improvement Program for Holt County. The hearing will be held at the Holt County Courthouse, in the County Board Meeting Room, in O'Neill, Nebraska, on Tuesday, February 18, 2025, at 11:15 A.M.

Legislation enacted by a prior session of the Legislature requires each county and municipality to develop a one year program of road or street improvement and a long range plan for an additional five years. A public hearing is required in order that interested parties may be informed as to what improvements are planned during the succeeding five years. After the public hearing, the Board will adopt the program with any necessary revisions and submit the program to the Board of Public Roads, Classifications and Standards.
