The Holt County Board of Supervisors met as a Board of Equalization with all members present. County Assessor Tim Wallinger, Deputy County Treasurer Cathy Fuhrer and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on June 23, 2022, in the Holt County Independent.

Chairman Frahm convened the meeting at 9:00 A.M. with the flag salute.

Motion by Paxton, 2nd by Breiner, to approve the minutes of the June 15, 2022, meeting as printed. Voting Aye: Treptow, Keyes, Butterfield, Breiner, Paxton and Tielke. Voting Nay: None. Abstain: Frahm. Motion carried.

Chairman Frahm convened a public hearing at 9:01 A.M. to receive public comment on the Motor Vehicle Tax Exemption Applications on file for: Building Blocks for Community Enrichment for a 2019 Chevrolet Malibu, 2-2017 Chevrolet Malibu, 2011 Chevrolet Impala, 2019 Altima and 2017 Malibu hybrid. No one appeared to comment.

Motion by Butterfield, 2nd by Paxton, to approve the valuation listing as submitted by the Assessor, for the overvalued parcels of real estate in Holt County for 2022. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Tielke, Treptow and Frahm. Voting Nay: None. Motion carried.

Motion by Tielke, 2nd by Paxton, to adjourn from public hearing at 9:04 A.M. and return to regular session. Voting Aye: Butterfield, Breiner, Paxton, Tielke, Treptow, Keyes and Frahm. Voting Nay: None. Motion carried.

Motion by Tielke, 2nd by Breiner, to approve the Motor Vehicle Tax Exemption Applications on file for: Building Blocks for Community Enrichment for a 2019 Chevrolet Malibu, 2-2017 Chevrolet Malibu,  2011 Chevrolet Impala, 2019 Altima and 2017 Malibu hybrid. County Assessor Tim Wallinger requested that a series of documents setting forth the process used in determining the assessed valuation along with the property record card of each parcel being protested be made a part of the official record.

Said request was granted by the Chairman.

Time was allowed for the Board to review, hear and consider valuation protests for 2022. 

Protests were heard from Matt Fritz and Patricia Karo.

The Holt County Board of Supervisors met in regular session as per adjournment with all members present. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on June 23, 2022, in the Holt County Independent.

Chairman Tielke convened the meeting at 9:59 A.M. and informed the public of the location of the Open Meeting Poster.

Motion by Butterfield, 2nd by Keyes, to approve the minutes of the June 15, 2022, meeting as printed. Voting Aye: Treptow, Keyes, Butterfield, Breiner, Paxton, and Tielke. Voting Nay: None. Abstain: Frahm.  Motion carried.

Addition to the agenda: Order Issuance of Tax Sale Certificates - Resolution to Direct Co. Attorney to foreclose on Tax Certificates.

Time was allowed for public comment. Holt County Economic Development Director Shelby Regan introduced Daniel Schartz to the Board, he is the new project manager for the Holt County Economic Development Office.

Claims on file were reviewed.

Matt Fritz with Niobrara Valley Electric Membership Corporation was present to discuss with the Board the possibility to perform and cost share a broadband feasibility study in Holt County.



RESOLUTION #2022-09

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

WHEREAS, the County of Holt, Nebraska, is the owner and holder of several Certificates of Tax sale on several parcels of real estate issued to the County of Holt for all delinquent regular taxes thereon, which have been regularly advertised and offered for sale at tax sale and remaining unsold for want of bidders, were sold to the County of Holt and Certificates of Tax Sale issued thereunder the provisions of Nebraska Revised Statutes, Section 77-1809 (Reissue 1990); and

WHEREAS, more than two (2) years and less than five (5) years elapsed since the issuance of such respective Certificates of Tax Sale and by reason thereof, the right for redemption of the owners or claimants of such respective tracts has expired.

NOW THEREFORE, BE IT RESOLVED that the County Attorney of Holt County, Nebraska, be and hereby is directed as promptly under the circumstances as it is reasonably possible so to do, to institute action to foreclose the lien of all taxes delinquent whether regular or special, on all real estate within Holt County, Nebraska, which having been heretofore advertised and offered for sale and remaining unsold for want of bidders was sold to the County of Holt, and further, said County Attorney can proceed to foreclose the Certificate of Tax Sale issued; and 

BE IT FURTHER RESOLVED that a receipt of the County Treasurers report of delinquent real estate taxes has been received and to direct the County Treasurer to issue Tax Sale Certificates to Holt County, Nebraska for all parcels delinquent for two (2) or more years.



The foregoing resolution was introduced by Supervisor Frahm, who moved its adoption. Supervisor Paxton seconded the motion. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Butterfield, 2nd by Breiner, to approve the surety bond on file for Heath Dobrovolny, Francis Township Treasurer. Voting Aye: Butterfield, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Motion by Butterfield, 2nd by Frahm, to appoint Grace Coleman to the Holt County Planning & Zoning Board for District 7 to complete the 2022 term. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Butterfield and Tielke. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Treptow, to approve the Budget Calendar for 2022-2023 as presented. Voting Aye: Paxton, Frahm, Treptow, Keyes, Butterfield, Breiner  and Tielke. Voting Nay: None. Motion carried.

RESOLUTION #2022-10

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

WHEREAS, it has come to the attention of the Holt County Board of Supervisors that existing appropriations in the County Budget, for the year ending June 30, 2022, are insufficient to continue the operation of the District Judge and Emergency Manager.

NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF SUPERVISORS, there is hereby appropriated to the District Judge $1.40, Emergency Manager $4,840.78, Clerk of the District Court $822.67, Road Supervisor $1,000.08 and Surveyor $1,011.58 from the excess authority in the Personnel Function for the fiscal year ending June 30, 2022, and to approve the transfer of budget authority from the Personnel Function to the Miscellaneous General Function for $300,000.00.



The foregoing resolution was introduced by Supervisor Paxton, who moved its adoption. The motion was seconded by Supervisor Frahm. Voting Aye: Frahm, Treptow, Keyes, Butterfield, Breiner, Paxton and Tielke Voting Nay: None. Motion carried.

Motion by Frahm, 2nd by Paxton, to set bid date for bridge repairs for C45(551) & C45(554) on July 29, 2022, at 11:00 A.M. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Paxton, to approve the Right of Way permit for Great Plains Communications for fiber optic telecommunications cable in Sections 3, 4, 7, 8, 9-26-9; Sections 9, 10, 11, 12, 16, 17, 18-26-10; Sections 13, 14, 15, 19, 20, 21-26-11. Voting Aye: Butterfield, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Gary Connot Road Superintendent presented his Department Activity Report.

Chairman Tielke adjourned the meeting at 12:08 A.M. until July 18, 2022, at 9:15 A.M.
