The Holt County Board of Supervisors met as a Board of Equalization with all members present. County Assessor Tim Wallinger, County Treasurer Shelly Ross and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on April 6, 2023, in the Atkinson Graphic.

Chairman Frahm convened the meeting at 9:30 A.M. with the flag salute.

Motion by Paxton, 2nd by Breiner, to approve the minutes of the March 31, 2023, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Tielke and Frahm. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Tielke, to approve the tax list corrections #23-007 to #23-009 as submitted by the Assessor. Voting Aye: Keyes, Neiman, Breiner, Paxton, Tielke, Treptow and Frahm. Voting Nay: None. Motion carried.

The Holt County Board of Supervisors met in regular session as per adjournment with all members present. This meeting publicized to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on April 6, 2023, in the Atkinson Graphic.

Chairman Tielke convened the meeting at 9:45 A.M. and informed the public of the location of the Open Meeting Poster.

Motion by Keyes, 2nd by Neiman, to approve the minutes of the March 31, 2023, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

The Treasurer's Report was presented and placed on file.

County Treasurer Shelly Ross discussed opening the Holt County Courthouse on Arbor Day to accommodate our taxpayers in Holt County. Due to short notice the Holt County Supervisors Board meeting for 2023 will be on April 27.

Motion by Paxton, 2nd by Keyes, for the Holt County Courthouse to be open on Arbor Day starting in 2023 and employees will be entitled to one personal day in place of being closed. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

The Board reviewed claims on file.

Motion by Frahm, 2nd by Paxton, the Holt County Board of Supervisors waive the potential conflict of interest for Baylor Evnen Wolfe and Tannehill, LLP to represent a co-defendant county and to execute the waiver on behalf of Holt County. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Motion by Frahm, 2nd by Paxton, to approve the surety bond on file for Rodney W. Smith, Holt County Public Defender. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

No action taken on the disposal of surplus inventory resolution.

Marv Fritz and Gene Kelly with the Planning and Zoning Board were present to update the Board on the conference that Marv attended and discuss the upcoming Planning & Zoning meeting.

Motion by Frahm, 2nd by Paxton, to accept the bid from FCF Construction for the replacement of concrete at the Holt County Courthouse for a total of $37,045.00 which will include remove and replace: west main entry walkway and step at the top of the main entry. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Frahm, to accept the low bid from Tracy Plumbing to install 15x15 sink in County Court office for $2,600.00. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Motion by Frahm, 2nd by Breiner, to void check #23020040 to Heartland Fire Protection for $260.00 due to duplicate payment. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

The Finance Committee reported that the County Officials had remitted their monthly fees to the County Treasurer as required.

Correspondence was reviewed.

Jane Kleeb & Tom Genung with Bold Nebraska & the Easement Action Team were present to discuss carbon pipelines and landowner property rights.

Weed Superintendent Bill Babutzke submitted his Quarterly Report.

Motion by Keyes, 2nd by Paxton, to appoint Jim Roeder as Grading Foreman effective immediately at $4,583.33 monthly and upon successful completion of 90 day probation period will then receive full foreman salary. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Frahm, to allow the new motorgrader operators to attend the motorgrader training in Knox County with Brian Jackson Construction for $170.00 per employee. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Paxton, to approve the electrical change order with North Central Automation for the O'Neill shop addition for $2,037.00. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

Motion by Treptow, 2nd by Breiner, to approve the Right of Way permit for Merwyn French for irrigation electrical cable in Sections 2 & 3-28-10. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Motion by Frahm, 2nd by Breiner, to approve the consignment of the surplus 2011 John Deere 770G motorgrader with Pavel Auction Services through AuctionTime online auction. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Road Superintendent Gary Connot presented the Road Department Activity Report.

Motion by Frahm, 2nd by Treptow, to approve the following claims. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.
