The Holt County Board of Supervisors met as a Board of Equalization with all members present. County Assessor Tim Wallinger, County Treasurer Shelly Ross and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943.  Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on December 21, 2023, in the Atkinson Graphic.

Chairman Frahm convened the meeting at 9:35 A.M. with the flag salute and informed the public of the location of the Open Meeting Poster. Motion by Paxton, 2nd by Keyes, to approve the minutes of the December 18, 2023, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Tielke  and Frahm. Voting Nay: None. Motion carried.

Chairman Frahm convened a public hearing at 9:36 A.M. to receive public comment on the Motor Vehicle Tax Exemption Applications on file for: Building Blocks for Community Enrichment on a 2017 Dodge Grand Caravan & 2024 Nissan Altima; The Evangelical Lutheran Good Samaritan Society – Atkinson on a 2008 Dodge Grand Caravan; Faith Community Church on a 1997 International Bus and a 2002 Ford Econoline; Valley Hope Association on a 2005 Ford Freestar Van; West Holt Memorial Hospital on a 2019 Ford F53 Motorhome; Word of Life Christian Center on a 2012 LGS Industries enclosed trailer. No one appeared to comment.

Motion by Paxton, 2nd by Tielke, to approve the tax list corrections #23-030 through #23-031 as submitted by the Assessor. Voting Aye: Keyes, Neiman, Breiner, Paxton, Tielke, Treptow and Frahm. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Neiman, to approve two tax refund requests for 2022 taxes paid on parcel #450779101 for $486.82 and parcel #4500779100 for $311.08. Voting Aye: Neiman, Breiner, Paxton, Tielke, Treptow, Keyes and Frahm. Voting Nay: None. Motion carried.

The Board discussed the 2023 Green Plains Atkinson LLC appeal to TERC.

Motion by Paxton, 2nd by Breiner, to adjourn from public hearing at 9:55 A.M. and return to regular session. Voting Aye: Neiman, Breiner, Paxton, Tielke, Treptow, Keyes and Frahm. Voting Nay: None. Motion carried.

Chairman Tielke convened the meeting at 9:58 A.M. and informed the public of the location of the Open Meeting Poster.

UNL Extension Educator Amy Timmerman was present to recommend the appointment of Molly Jennings to the Holt County Extension Board to represent District 5 on the Extension Board.

Motion by Keyes, 2nd by Breiner, to appoint Molly Jennings to the Holt County Extension Board to represent District 5 for a 3 year term. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Frahm, 2nd by Neiman, to allow the direct deposit payroll and other related claims. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Marv Fritz Holt County Planning & Zoning Administrator was present by phone to update the Board on the clarification the Board requested on the proposed addition of solar energy conversion system to the Holt County Planning & Zoning regulations. 

Motion by Paxton, 2nd by Keyes, to approve the proposed addition of guidelines pertaining to the construction and operation of solar energy conversion system to the Holt County Planning and Zoning Regulations. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

Motion by Neiman, 2nd by Paxton, to approve the Right of Way permit for Tim Borer for electrical cable for irrigation in the NW ¼ 7-30-13. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

Resolution #2023-18 - Preliminary Engineering Services Agreement – BK1931 Supplemental Agreement No. 2

Motion by Supervisor Keyes, 2nd by Supervisor Paxton to approve the Preliminary Engineering Services Agreement. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.  The complete resolution will be printed in the official minutes.

The Board reviewed the road and bridge policy.

Motion by Paxton, 2nd by Frahm, to approve the updated road and bridge policy as submitted by the Road Superintendent. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Gary Connot Road Superintendent presented his Department Activity Report.

Correspondence was reviewed.

Supervisor Paxton was excused at 11:14 A.M.

The Holt County Board of Supervisors met in statutory session with all members present. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943.  Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on December 28, 2023, in the Holt County Independent.

The meeting was called to order by the County Clerk, Cathy Pavel, at 9:46 A.M. with the flag salute. The Clerk informed the public of the location of the Open Meeting Poster. The first order of business being the selection of a Board of Supervisors Chairman for 2024. 

Motion by Paxton, 2nd by Neiman, to nominate Bill Tielke to serve as Chairman of the Board of Supervisors for 2024. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.   

Supervisor Tielke was declared elected and began presiding over the meeting.

Motion by Paxton, 2nd by Keyes, to nominate Doug Frahm to serve as Chairman of the Board of Equalization for 2024. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

The Board will continue with the policy when the Chairman for the Board of Supervisors or Chairman for Board of Equalization is absent the other Chairman will preside over that meeting.

Connot as Road Superintendent License #S-1159A,  Marv Fritz as Planning and Zoning Administrator, Deb Hilker as Emergency Manager and Ken Stenka as Veterans Service Officer, for the year beginning January 1, 2024. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

The Board discussed personnel and wages.

Sheriff Ben Matchett and Chief Deputy Ed Nordby were present to discuss wages for their departments.

Motion by Paxton, 2nd by Breiner, to continue with the 3 year plan implemented in 2023 and to increase the sheriff deputies' wages $2.00 per hour and to continue with the merit pay for the sheriff deputies. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

Motion by Frahm, 2nd by Neiman, to increase the jailer wages $1.00 per hour. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Frahm, to set the jail manager stipend at $300.00 monthly. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Frahm, to set the annual salary for the Planning and Zoning Administrator at $9,000.00. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Motion by Frahm, 2nd by Paxton, to set the annual salary for the Emergency Manager at $29,800.00. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Frahm, to set the annual salary for the Veterans Service Officer at $53,500.00. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Neiman, to set the Annex yearly cleaning contract at $1,700.00 a month. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Frahm, to set the part-time Courthouse Custodian wage at $19.00 per hour. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Neiman, to set the Courthouse Custodian salary at $45,000.00 for all Holt County Courthouse buildings and to continue with monthly reports to the Board. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Motion by Neiman, 2nd by Paxton, to approve the Construction Engineering Services Agreement between Holt County and Speece Lewis Engineers on the Atkinson Southeast Project for a total cost of $260,626.95. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Paxton, to increase the hourly road department employees' wage $1.00 per hour. The Board will continue with the policy that all hourly road employees will receive $.05 for every consecutive year of service to Holt County. The $.05 increase will be added to each employee's base pay. This increase will be earned every calendar year. Every employee has to complete 1 full year of service before becoming eligible. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

Motion by Neiman, 2nd by Keyes, to set the salary for the Grading Foreman, Truck Foreman and Asphalt Foreman salary at $64,000.00 a year. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

Motion by Keyes, 2nd by Frahm, to set the salary for the Road Superintendent at $80,000.00 a year which includes the full $9,750.00 stipend that is received from the State for the Road Superintendent to have a Class A Bridge Inspection license. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Chairman Tielke adjourned the meeting at 1:05 P.M. until January 16, 2024, at 9:45 A.M.
