The Holt County Board of Supervisors met as a Board of Equalization with all members present. County Assessor Tim Wallinger, Deputy County Treasurer Cathy Fuhrer and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on June 6, 2024, in the Holt County Independent.

Chairman Frahm convened the meeting at 9:00 A.M. with the flag salute.

Motion by Paxton, 2nd by Keyes, to approve the minutes of the May 31, 2024, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Tielke and Frahm. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Neiman, to approve the valuation listing for parcel #'s: 450048800, 450019330, 450000473, 450019975, 450023507, 450024069, 450024270, 450024269, 450859600, 450024690, 450199000, 450200800, 450755600, 450019988, 450021444 & 450575600 as submitted by the Assessor, for the over-valued parcels of real estate in Holt County for 2024. Voting Aye: Keyes, Neiman, Breiner, Paxton, Tielke, Treptow and Frahm. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Breiner, to approve the valuation listing for parcel #450611701 as submitted by the Assessor, for the over-valued parcel of real estate in Holt County for 2024. Voting Aye: Neiman, Breiner, Paxton, Treptow, Keyes and Frahm. Voting Nay: None. Abstain: Tielke. Motion carried.

Motion by Paxton, 2nd by Tielke, to approve the valuation listing for parcel #450021395 as submitted by the Assessor, for the under-valued parcel of real estate in Holt County for 2024. Voting Aye: Breiner, Paxton, Tielke, Treptow, Keyes, Neiman and Frahm. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Tielke, to concur with the Assessor and approve the list of Destroyed Properties in Holt County for 2024, on parcel numbers: 450020383 as submitted by the Assessor. Voting Aye: Paxton, Tielke, Treptow, Keyes, Neiman, Breiner and Frahm. Voting Nay: None. Motion carried.

Motion by Tielke, 2nd by Paxton, to approve the tax list correction #24-014 as submitted by the Assessor. Voting Aye: Tielke, Treptow, Keyes, Neiman, Breiner, Paxton and Frahm. Voting Nay: None. Motion carried.

The Holt County Board of Supervisors met in regular session as per adjournment with all members present. This meeting publicized pursuant to Section R.R.S. 1943.  Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on June 6, 2024, in the Holt County Independent.

Chairman Tielke convened the meeting at 9:20 A.M. and informed the public of the location of the Open Meeting Poster.

Motion by Paxton, 2nd by Frahm, to approve the minutes of the May 31, 2024, meeting as printed. Voting Aye: Treptow, Keyes, Neiman, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Time was allowed for public comment. Holt County Economic Development Director Shelby Regan was present.

The Board reviewed claims on file.

Correspondence was reviewed.

The Treasurer's Report was placed on file.

RESOLUTION #2024-07

OF THE

HOLT COUNTY BOARD 

OF SUPERVISORS

WHEREAS, the County of Holt, Nebraska, is the owner and holder of several Certificates of Tax sale on several parcels of real estate issued to the County of Holt for all delinquent regular taxes thereon, which have been regularly advertised and offered for sale at tax sale and remaining unsold for want of bidders, were sold to the County of Holt and Certificates of Tax Sale issued thereunder the provisions of Nebraska Revised Statutes, Section 77-1809 (Reissue 1990); and

WHEREAS, more than two (2) years and less than five (5) years elapsed since the issuance of such respective Certificates of Tax Sale and by reason thereof, the right for redemption of the owners or claimants of such respective tracts has expired.

NOW THEREFORE, BE IT RESOLVED that the County Attorney of Holt County, Nebraska, be and hereby is directed as promptly under the circumstances as it is reasonably possible so to do, to institute action to foreclose the lien of all taxes delinquent whether regular or special, on all real estate within Holt County, Nebraska, which having been heretofore advertised and offered for sale and remaining unsold for want of bidders was sold to the County of Holt, and further, said County Attorney can proceed to foreclose the Certificate of Tax Sale issued; and

BE IT FURTHER RESOLVED that a receipt of the County Treasurers report of delinquent real estate taxes has been received and to direct the County Treasurer to issue Tax Sale Certificates to Holt County, Nebraska for all parcels delinquent for two (2) or more years.

The foregoing resolution was introduced by Supervisor Frahm, who moved its adoption. Supervisor Neiman seconded the motion. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Correspondence was reviewed.  

The Finance Committee reported that the County Officials had remitted their monthly fees to the County Treasurer as required.

Motion by Frahm, 2nd by Keyes, to approve the surety bonds on file for Chambers Rural Fire District #6. Voting Aye: Neiman, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Deputy Sheriff Ed Nordby was present to discuss with the Board the request from Verizon Wireless for better access to their antenna site. Sheriff Matchett and Deputy Nordby will discuss this request with Jail Standards.

Discussion was held on what to call the new building, it will be referred to as the Holt County Administrative Building.

Phone and internet services were discussed for the Holt County Administrative Building.  

Motion by Paxton, 2nd by Breiner, to approve the zoning applications on file for Patrick J. Chohon, Ratli Z LLC on two tracts in the SW ¼ & SE ¼ 25-31-10 and for James R. Galyen, Full Sprint LLC on two tracts in the NW ¼ & SW ¼ 15-30-14. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Neiman and Tielke. Voting Nay: None. Motion carried.

Informal bids were received for a division wall with door in the Administrative Building. Bids were received from Tracy Construction for $3,650.00 & from Craig Cleveland for $1,675.18.

Motion by Keyes, 2nd by Frahm, to accept the bid from Tracy Construction for $3,650.00 for a division wall with door in the Holt County Administration Building. Voting Aye: Paxton, Frahm, Treptow, Keyes, Neiman, Breiner and Tielke. Voting Nay: None. Motion carried.

Road Superintendent Gary Connot presented his Department Activity Report.

Motion by Paxton, 2nd by Neiman, to accept the Professional Services Work Order for structure #C004513910, Task #.001 with Speece Lewis for $8,200.00. Voting Aye: Frahm, Treptow, Keyes, Neiman, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

RESOLUTION #2024-08

OF THE

HOLT COUNTY BOARD 

OF SUPERVISORS

COMES NOW Holt County, Boyd County, and Boyd/Holt E-911 Dispatch Center and agree as follows:

1. Boyd/Holt E-911 Dispatch Center (“Dispatch Center”) is a Nebraska Nonprofit Corporation created pursuant to Neb. Rev. Stat. §86-1001 to 86-1009.

2. The parties agree that the method for funding the Dispatch Center will be amended as it relates to Holt County and all of the entities contained therein as follows:

a. Holt County shall continue to contract with the entities.

b. Boyd County shall continue to contract with the entities.

c. Dispatch Center will continue to provide financial information to Holt County and Boyd County, setting forth the allocations for each of their communities based upon population, as the Dispatch Center has done since its inception.

d. Boyd County will levy the taxes and pay the assessments for Boyd County and for all of the entities that have contracted with Boyd County. This Agreement does not change the current billing system as it relates to Boyd County. This Agreement does not change the formula for the allocations. 

e. Commencing in the 2024-2025 budget year for each entity, Holt County will levy for the assessments as allocated by Boyd/Holt E-911 and Holt County will pay the assessments to the Dispatch Center. As such, there will be no direct billings from Dispatch Center to any of the other entities with whom Holt County has contracted. Holt County and all such payments will be received from Holt County.

f. Any funds previously disbursed by Holt County for the benefit of any of the entities shall be paid to Dispatch Center by those communities. Dispatch Center is hereby authorized to initiate any and all legal action to collect the same from any entities who have received funds but have not paid their assessments, including interest, attorney fees, or other damages.

The foregoing resolution was introduced by Supervisor Breiner, who moved its adoption. Supervisor Frahm seconded the motion. Voting Aye: Keyes, Neiman, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Chairman Tielke adjourned the meeting at 12:58 P.M. until June 28, 2024, at 9:15 A.M.
